FSMA:  What do you need to know?

The Food Safety Modernization Act (FSMA) is intended to reduce the risk of microbial contamination of fresh produce.

FSMA has 7 rules, two of which may impact NH farms and value added food producers. 

The Produce Safety Rule applies to “farms” or those who grow, harvest, pack or hold covered produce.  The rules apply to produce or raw agricultural commodities "RACs" generally eaten raw, ie greens, melons, tomatoes, applies, etc. (aka “covered produce”).  They do NOT apply to produce not eaten raw, ie sweet corn, potatoes, pumpkins, etc.

The Preventive Controls rule applies to “facilities” that manufacture, process, pack or hold human food. 


There are simplified paths to compliance that will apply to small operations conducting certain types of activities, but the details as well as the amount of time you will have to come into compliance are different for each part of FSMA.

DISCLAIMER:  We are committed to helping you make sense of these rules, but please keep in mind that the rules are hundreds of pages long and our understanding of them is evolving.  To that end, UNHCE staff members are working on educational tools and programming to help you make sense of them.  We are participating in a task force of NH farmers and organizations who work with farmers across the state and the region.  Additionally we are learning from and sharing information with other Extension programs across the region.  Our goals are to understand the rules and develop tools to communicate them back to farmers and food businesses.  What follows represents what we have learned so far.  Also, we are not the FDA and at the end of the day the only people whose interpretations will count are the interpretations of the FDA inspectors.
